Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern access to and use of the APPix Marketplace website and related services (collectively, the “Platform”) operated by Хостадо Сълушънс ООД (Hostado Solutions, UIC 208502081; “we”, “us”). By accessing the Platform, creating an account, or completing a purchase, you (“you”) agree to these Terms. If you use the Platform on behalf of a company, you represent that you have authority to bind that entity.

2. Eligibility & accounts

You must be at least the age of digital consent in your jurisdiction (typically 16 in the EU; higher ages may apply in some U.S. states) and able to form a binding contract. You are responsible for accurate registration information and for safeguarding credentials. You must notify support@appix.bg of unauthorized use.

3. Marketplace role

The Platform is a curated marketplace that facilitates listings, discovery, checkout, and support workflows for digital software products (“Products”) offered by independent studios or sellers (“Studios”). Unless expressly stated on a listing, Studios are responsible for their Products, including descriptions, licensing, delivery, quality, updates, and compliance with applicable laws.Hostado Solutions operates the Platform, payment orchestration via Stripe, and certain marketplace-wide policies and support coordination.

4. Orders, price & taxes

Listings show prices in the currency indicated at checkout. You authorize us and Stripe to charge your selected payment method for the total amount shown, including applicable taxes where we are required to collect them. You are responsible for providing accurate billing and tax information.

5. Licenses & delivery

Unless otherwise stated on the product page or separate license terms linked from the listing, purchase grants you a non-exclusive license to use the Product according to the Studio’s stated scope (e.g. seats, environments, redistribution limits). Delivery may include download links, license keys, repository access, or onboarding instructions. You may not circumvent technical protection measures or exceed licensed use.

For security-sensitive deliveries, source code may be transferred first to the Appix Support Team as a temporary handoff checkpoint and then delivered to the buyer. This workflow is used to improve delivery integrity and reduce transfer risk for both sides.

6. Acceptable use

You agree not to:

• Violate law or third-party rights;
• Upload malware, scrape the Platform in a manner that impairs service, or probe systems without authorization;
• Misrepresent identity, manipulate reviews, or abuse the checkout process;
• Resell marketplace access, accounts, or bulk-purchased licenses contrary to listing terms;
• Use the Platform to build a competing directory that systematically harvests Studio or buyer data.

We may suspend or terminate accounts for violations.

7. Intellectual property

The Platform’s branding, UI, and content we create are owned by Hostado Solutions or licensors. Studios retain rights to their Products subject to licenses granted to buyers. Feedback you provide may be used to improve the Platform without obligation to you.

8. Third-party services

We rely on third parties such as Stripe (payments) and Supabase (auth/data). Their terms and privacy notices apply to their processing. We are not responsible for third-party outages outside our reasonable control.

9. Disclaimers

THE PLATFORM AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT WHERE ALLOWED. STUDIOS ARE INDEPENDENT THIRD PARTIES; WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OF STUDIO SOFTWARE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF Hostado Solutions ARISING OUT OF OR RELATED TO THE PLATFORM OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO Hostado Solutions FOR PLATFORM FEES ATTRIBUTABLE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED EUROS (€100) IF NO SUCH FEES APPLIED. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS-IN SUCH CASES OUR LIABILITY IS LIMITED TO THE MINIMUM PERMITTED BY LAW.

11. Indemnity

You will defend and indemnify Hostado Solutions against claims arising from your misuse of the Platform, your breach of these Terms, or your violation of law-except to the extent caused by our willful misconduct.

12. Studio obligations (summary)

Studios selling through the Platform must provide accurate listings, honor delivered licenses, comply with export and sanctions laws, respect buyer privacy, and cooperate with reasonable marketplace investigations. Additional seller terms may apply via onboarding documents.

13. Suspension & termination

We may suspend or terminate access for risk, legal, or policy reasons, with or without notice where permitted. You may close your account subject to completing outstanding orders. Provisions that by nature should survive (e.g. liability limits, governing law) survive termination.

14. Governing law & disputes

These Terms are governed by the laws of Bulgaria, excluding conflict-of-law rules. Courts in Bulgaria have jurisdiction, subject to mandatory consumer protections in the EU/EEA/UK country where you habitually reside-you may also bring claims in that country where the law so requires. For business users outside the EU, exclusive jurisdiction may lie with Bulgarian courts unless otherwise agreed in writing.

U.S. users: nothing in these Terms limits rights that cannot be waived under applicable U.S. federal or state law (including certain consumer warranty remedies where non-waivable).

15. Export & sanctions

You may not use or export Products in violation of EU, U.S., or other applicable sanctions or export control laws. Studios are responsible for classification of their software where relevant.

16. Changes

We may modify these Terms. We will post updates and revise the “Last updated” date. Material changes may require additional notice or consent where legally required. Continued use after changes become effective constitutes acceptance unless applicable law requires otherwise.
